1. Who we are

These Terms govern your use of Candle Clash (the "Service"), operated by Hawkins Capital LLC ("we", "us", "our"). By accessing or using the Service you agree to these Terms.

2. The Service

Candle Clash is a fictional, arcade-style candlestick simulation game intended for entertainment and educational purposes only. It is not real trading, not a brokerage service, and nothing in the Service constitutes financial, investment, legal, or tax advice. You are solely responsible for any decisions you make in real markets.

3. Acceptable use

You agree not to misuse the Service, including by: using it unlawfully; engaging in fraud or spam; infringing intellectual property; introducing malware; probing, scanning, or scraping; or interfering with security or other users' enjoyment of the Service.

4. Accounts

You are responsible for safeguarding your account credentials and for activity under your account. You must provide accurate information and keep it up to date.

5. Intellectual property

We retain all rights, title, and interest in the Service, including software, content, branding, and documentation. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes.

6. Payments, subscriptions and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Checkout Buyer Terms and our Refund Policy.

In-game perks are consumable digital items granted to your account and used during gameplay. "Remove Ads" is a one-time digital purchase tied to your account.

7. Service availability

We do not warrant that the Service will be uninterrupted, error-free, or available at any particular time. To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, express or implied.

8. Suspension and termination

We may suspend or terminate your access to the Service at any time for: material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the Service at any time.

9. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service shall not exceed the amounts you paid us in the 6 months preceding the claim. We are not liable for indirect, incidental, consequential, special or exemplary damages, including loss of profits, data, or goodwill.

10. Governing law

These Terms are governed by the laws of the State in which Hawkins Capital LLC is organized, without regard to conflict-of-laws rules.
